In 2022, a school employee reportedly heard students talking about a relationship between Romero and a child. The Las Vegas Police Department investigated the claim, and the victim came forward. Court documents claimed the sexual interactions happened at least five times.

The New Mexico Department of Justice took over the case, and Romero was booked at the San Miguel County Detention Center.
