Hunter Biden's lawyers have until next week to decide if he will testify in gun trial

June 7 (UPI) -- As Hunter Biden's federal gun trial adjourned for the day Friday afternoon, defense lawyers said they won't call more witnesses. They have until Monday, though, to decide whether Biden will testify.

The trial adjourned unexpectedly early when the defense decide not to call President Joe Biden's brother James to the stand.

James Biden had been waiting in the witness room, and the expectation was that he would testify.

Closing arguments in the case will begin next week, but it remained unclear whether Hunter Biden, himself, will testify in the case.

There will be no defense expert witnesses, but attorney Abbe Lowell still was finalizing a witness list and is also expected to file for Judge Maryellen Noreika to dismiss the case as the defense case resumes Monday.

That motion is often made as defense lawyers wrap up their cases.

As Noreika dismissed jurors on Friday, she said testimony would resume Monday.

First Lady Jill Biden had come back to court to observe after lunch.

Also on the same day federal prosecutors in Hunter Biden's trial on gun and drug charges rested their case, Biden's defense called his daughter Naomi to testify Friday.

During the month he bought the gun, she said, he "seemed great" and she saw no drug evidence in his truck during a visit.

Naomi Biden testified that in the key period of October 2018, when he bought the gun and signed the form prosecutors accuse him of lying on, Hunter Biden seemed hopeful.

Naomi said while visiting her father in October 2018 she did not see any evidence of drug use or drug paraphernalia in vehicles Hunter Biden used at that time.

She testified that in late October 2018 Hunter Biden "seemed great. He seemed hopeful."

Naomi testified that Hunter's addiction to cocaine began after her uncle, his brother, died in 2015. She said she became aware he struggled with addiction but under questioning from prosecutor Leo Wise she said she didn't witness him doing drugs.

"No, I never saw him use," she said from the stand.

Prosecutors are trying to prove Biden knowingly lied on a federal drug form about a question regarding drug addiction. He bought the gun and filled out the form in October 2018.

Defense lawyers for Biden contend he did not consider himself an addict at the time he bought the gun and so could not have knowingly lied on that question.

Naomi Biden appeared emotional during testimony and her father was seen wiping away tears as she testified.

Federal prosecutors in Hunter Biden's trial over gun and drug charges rested their case Friday morning.

Special counsel David Weiss did so after calling two final expert witnesses on the trial's fifth day in Wilmington, Del.

Drug Enforcement Administration special agent Joshua Romig testified about Biden's use of coded text messages allegedly relating to cocaine use.

"It's rudimentary, pretty standard code," Romig said in reference to the terms "baby powder" and the "really soft stuff" found on Biden's phone.

FBI forensic chemist Jason Brewer briefly took the stand prior to Romig, testifying about drug residue found in a bag Biden stored a handgun in.

After the prosecution rested, Biden's lawyers asked Judge Maryellen Noreika to acquit their client, calling the case an improper prosecution under the Second Amendment.

Noreika reserved her judgment in the matter.

Hunter Biden faces three federal charges after being accused of buying and owning the gun while using illegal drugs.

The son of President Joe Biden pleaded not guilty to the three charges.

Weiss' team rested its case after several days presenting evidence meant to illustrate the younger Biden's dependency on crack cocaine at the time he purchased the handgun in 2018.

Earlier in the week, court heard from the man who sold Biden the firearm, as well as the police officer who later found it.

Hallie Biden, widow of the late Beau Biden, also testified, telling the court she found Hunter Biden's gun, along with drugs, while cleaning his truck in October of 2018.

She then threw the gun in a trash can at a nearby grocery store, but later returned to try to retrieve it.
