Man possibly killed due to testimony in 2015 murder case, APD says

ALBUQUERQUE, N.M. (KRQE) – In seemingly different incidents, authorities are looking into two deaths. Both deaths happened early Saturday morning.

1 a.m. NE shooting

The Albuquerque Police Department (APD) said reports came in just after 1 a.m. about a shooting near 525 San Pedro Drive NE. A man had been killed.

APD identified the victim as Kenneth Ellis and said they’ve arrested Theodore Toney, 45, in relation to the shooting.

After an investigation, officials said Ellis, his partner, and a relative were at a dance at the location. Ellis went to the DJ booth and was shot in the back of the head. Police claimed a video showed a man matching Toney’s description after the shooting.

APD said Ellis had testified in 2015 in a murder case that ended with a conviction of a relative of Toney’s. They said Toney’s father had previously made threats toward Ellis and his family “because of the testimony.”

Toney was identified as the suspect in the recent overnight shooting and was arrested Saturday afternoon. He’s facing a murder with a firearm enhancement charge.
